2. If the matter is not resolved at the first instance by the Grievance Officer, then the same may then be settled by arbitration by a single Arbitrator appointed by Vruddhi Motors. The arbitration shall be held, in Delhi, in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The language of Arbitration shall be in English.

 

14.             BREACH OF THE TERMS

1. Without prejudice to Vruddhi Motors other rights under these Terms, if you breach these Terms and in any way, or if Vruddhi Motors suspect that you have breached these Terms in any way, Vruddhi Motors may

• send you one or more formal warnings;
• temporarily suspend your access to Vruddhi Motors Services and Services;
• permanently prohibit you from accessing Vruddhi Motors Services and Services;
• block computers using your IP address from accessing Vruddhi Motors Services and Services;
• contact any or all of your internet service providers and request that they block your access to Vruddhi Motors Services and Services;
• commence legal action against you, whether for breach of contract or recovery of amounts due or damages or otherwise; and
• suspend or delete your account on Vruddhi Motors Services and Services.

3. Please do not reveal trade secrets or other confidential information in your messages to Vruddhi Motors. Any and all rights to materials submitted to Vruddhi Motors become the exclusive property of Vruddhi Motors.

3. If any of these Terms is found to unenforceable or invalid by a court, that Term will be enforced to the fullest extent permitted by applicable law and the other Terms will continue to remain valid and enforceable.
4. These Terms, together with those agreements made a part of these Terms by reference, make up the entire agreement between Vruddhi Motors and you relating to your use of the Services, and replace any prior understandings or agreements (whether oral or written) regarding your use of the Website/Services.
5. In any such action or for any action Vruddhi Motors may initiate, Vruddhi Motors will be entitled to recover all legal expenses incurred in connection with the legal action, including but not limited to costs, both taxable and non-taxable, and reasonable attorney fees.
